About these Terms
These Terms apply to the Winset app for iPhone, this website and the Winset account service. Winset is a tool for planning strength training, recording Workouts and reviewing Progress. Read these Terms before you use it; if you do not agree with them, do not use Winset.
Alexis Morales Amaro operates Winset and is responsible for the service described here.
The Privacy Policy explains how information is handled. Your download is also covered by Apple’s App Store terms and the license that comes with the app. Nothing in these Terms limits a right that the law does not allow to be limited.
Who can use Winset, and your account
You must be at least 13 years old to use Winset. If the law where you live requires you to be older, or requires permission from a parent or legal guardian, you must meet those requirements before using Winset. If you are under 18, use Winset with the permission of a parent or legal guardian. You may not use Winset if applicable law prohibits you from doing so.
Winset’s training recommendations are designed for generally healthy adults, as the app states in Settings, and are not tailored to people under 18.
Do not create an account for someone else without their permission. Use an email address you control and keep your password to yourself. You are responsible for what is done through your account. If you think someone else has access, reset your password and tell support, without sending a password or a reset link.
Training is your decision
Winset organizes and tracks training. It offers ready-made Programs, can build a Program for a full gym, recommends weights and reps from what you have recorded, and shows your Progress, labeling an estimate as one. A recommendation or an estimate is not a judgment that an Exercise or a weight is right for you.
Winset does not give medical advice, does not diagnose or treat pain or injury, and is not an emergency service. It can work around discomfort you tell it about, but it cannot assess it. Get qualified guidance for medical conditions, concerning symptoms during exercise, pregnancy or postpartum training, or rehabilitation.
You choose your Exercises, equipment, technique and weights, and whether to train at all. Training carries risk, and Winset does not promise any strength, fitness or health result.
Your training data
The training you enter and record is yours. You allow Winset and its service providers to store and process it to run the features you use, as the Privacy Policy describes. That does not make it Winset’s.
Only enter or import information you have the right to use, and keep other people’s personal information out of names and notes.
Acceptable use
Use Winset in ways that respect the service and other people’s rights. Do not:
- Access another person’s account or bypass account or security controls.
- Introduce malicious code, interfere with the service or use it unlawfully.
- Misuse support or knowingly submit another person’s information as your own.
Winset may act to deal with misuse, a compromised account or a legal requirement. That does not affect the rights the law gives you.
Availability, offline use and sync
Winset depends on your iPhone, iOS, a connection and the account service, and any of them can interrupt it. Winset does not promise uninterrupted availability or immediate sync.
Once you are signed in and your training is on your iPhone, you can keep training without a connection. Signing in, restoring an account, loading the Program Library and deleting an account need one. Changes that have not uploaded exist only on that iPhone, so keep the app installed until they do.
An account is signed in on one iPhone at a time and has one Workout in progress at a time. Signing in on another iPhone signs the first one out, unless a Workout is in progress there; finish or discard it first. Signing out and deleting an account also wait until no Workout is in progress.
Export and import
Export a copy creates a file of your Programs and their Routines, your custom Exercises and your completed Workouts. It is a copy of your training, not a backup of everything: it leaves out your answers about yourself, your sign-in details, an unfinished Program draft and a Workout in progress. You are responsible for where you keep or send the file.
Import training data accepts a file exported by the same account. It adds what is missing, never overwrites existing training, and refuses a file it cannot read or one that would change training you already have. It does not move training between accounts, restore a Workout in progress or change your Current Program.
Signing out and deleting your account
You can stop using Winset at any time. Sign out uploads waiting changes, then removes the account’s training from the iPhone. Custom Exercises you created and an unfinished Program draft exist only on the iPhone and are removed with it, as the sign-out review tells you.
Delete account, in Profile → Settings → Account & data, permanently deletes the account and its training and cannot be undone. It needs a connection and no Workout in progress. The Privacy Policy lists what deletion does not reach, such as files you exported. Deleting the app does not delete the account.
Winset’s materials and other services
The app, this website, the Winset name and its artwork are protected by intellectual-property law. Using Winset does not give you ownership of them; you may use them as the app’s license and the law allow.
Apple’s App Store, and any other service you use with Winset, has its own terms and privacy practices. Winset, not Apple, provides support for the app.
What to expect from Winset
Winset’s numbers depend on what you enter and on your records reaching your account. Check anything that matters to you, and export a copy if you want one of your own. Not every feature will always be available, and a calculation may not fit your circumstances.
Nothing in these Terms removes a warranty, responsibility, remedy or consumer right that the law does not allow to be removed.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any rights you may have under mandatory consumer-protection laws in your place of residence remain unaffected.
Changes and contact
Winset and these Terms may change. When the Terms change, the new version appears on this page with new dates.
To raise a concern, contact support. Doing so does not stop you from using a legal remedy or contacting an authority. For questions about these Terms, email winset-support@code904.com.
